Information Regarding New Legislation in the Event of a Road Collision

Minerva Insurance informs its customers and partners that, according to recent amendments to the legislation concerning motor vehicles and road traffic, specific obligations have been introduced for drivers involved in a road collision.

The purpose of the legislation is to ensure the safer and faster management of incidents on the road network, especially in cases where the vehicles involved can be moved and their presence at the scene may obstruct traffic or create an additional risk.

When vehicles may be moved after a road collision

In the event of a road collision between motor vehicles, vehicles that can be moved must be transferred to the nearest safe location, so as not to obstruct the rest of the traffic, provided that:

  • there are no visible bodily injuries to any of the persons involved,
  • the intervention and/or presence of the Cyprus Police at the scene of the collision is not required,
  • the vehicles can be moved without towing,
  • the movement can be carried out without causing further damage to the vehicles or the road surface,
  • it is reasonable and safe under the circumstances prevailing at that time.

The vehicle may be moved by its driver or by another person who holds a valid driving licence and insurance cover, following the instruction of the driver of the vehicle involved.

What drivers must do before moving the vehicles

Before moving the vehicles, the drivers involved must take the following steps:

1. Immediately notify their insurance companies about the road collision.

2. Exchange the following information with each other:

  • -full names,
  • -insurance policy numbers,
  • -driving license numbers,
  • -vehicle details,
  • -telephone numbers.

3. Take photographs of the collision scene, including:

  • -the vehicles in their final position after the collision,
  • -the registration numbers of the vehicles,
  • -the damage caused,
  • -the surrounding area.

4. Exchange the photographs with each other and send them to the person indicated by their insurance company and/or its representative.

When taking and exchanging photographs, drivers must limit themselves to the information that is necessary for the handling of the incident, in accordance with personal data protection principles.

Cases where the procedure does not apply

The above procedure does not apply when:

  • -an uninsured vehicle is involved,
  • -a government vehicle is involved,
  • -any driver leaves the scene of the road collision,
  • -there are visible bodily injuries,
  • -the intervention or presence of the Police is required.

In such cases, drivers should act in accordance with the instructions of the competent authorities and contact their insurance company immediately.

Are there penalties for non-compliance?

Yes. Any person who violates the relevant provisions of the legislation is guilty of an offence and, upon conviction, is liable to a fine not exceeding €1,000.

The same fine may also be imposed on any person who encourages, forces, or attempts to encourage or force a driver involved in a road collision to breach the relevant obligations.

Useful reminder from Minerva Insurance

In the event of a road collision:

  • -remain calm,
  • -first check whether anyone has been injured,
  • -immediately notify your insurance company,
  • -exchange the necessary details with the other drivers involved,
  • -take photographs of the scene and the damage before moving the vehicles,
  • -move the vehicle only if it is safe and permitted under the circumstances.
